GENERAL TERMS AND CONDITIONS FOR PERSONAL TRAINING / GROUP TRAINING WITH TRAINER KARRIE GREGSON
General
The business relationship between the Personal Trainer Karrie Gregson, hereinafter referred to as the "Trainer," and the client, hereinafter referred to as the "Client," is exclusively governed by the following General Terms and Conditions in their valid version at the time of the service provision. Clients would include private individuals, companies, Group training, Online and in person.
Subject Matter of the Contract
The subject matter of the contract is individual advice and support for customers within the framework of the agreed training and health consultation.
Scope of Services
The Trainer offers the client a concept tailored to their needs. The concept includes various recommendations for training content, nutrition, and lifestyle. It takes into account the specific needs and physical abilities of the client. The Trainer ensures personalized advice, and client support is provided personally by the Trainer. The Trainer offers group sessions in the form of Bootcamp, Mama Fit, and Yoga incorporating various fitness modalities and levels. Additional services include health and fitness tests.
Training and Appointment Booking
Before the start of training sessions, a personal consultation takes place with the client. During the discussion, the content and goals are coordinated, and the client informs the Trainer about their health and physical limitations. A training session lasts 45- 60 minutes, and longer sessions are individually agreed upon with the customer. Sessions take place either at the Trainer's premises, the customer's location, or a public place, or online ZOOM as agreed. Appointments are made exclusively by arrangement, and cancellations must be made at least 24 hours before the agreed time. A fee equal to 50% of the price for a training session is charged for missed appointments with prior notification.
Client Obligations
The client is obligated to inform the Trainer, without prompting, about their fitness for sports before the start of the training session. If sudden health or well-being issues arise during training, the client must promptly inform the Trainer.
Group Fitness Training/Yoga Classes Registration/Cancellation
The client must register online for a class/ session at least 6 hours in advance. Cancellations of booked training sessions must be made at least 6 hours before the start of the training. Failure to cancel on time will count the session as booked
Payment Terms
The package payment must be settled before the package begins. The option of instalments is available with a 10% surcharge. Currently accepted payment methods include bank transfer, credit card, PayPal, and cash. The Trainer is not generally liable for customer damages, except for liability due to a violation of a contractual obligation or damages resulting from intentional or grossly negligent acts by the Trainer. The services mentioned in § 3 are considered essential contractual obligations of the Trainer. The client is explicitly advised not to bring valuables. The Trainer assumes no responsibility for valuables brought in by the client.
The Trainer is not liable for damages resulting from the client 's overestimation of themselves. If the client does not follow the Trainer's instructions and incurs damages as a result, the Trainer's liability is excluded.
Data Protection
The Trainer stores the customer's personal data and uses it exclusively to fulfill the subject matter of the contract as stated in § 3. Details regarding data protection are outlined in the Trainer's privacy policy.
Confidentiality
The Trainer is obligated to maintain confidentiality regarding all information about the client that becomes known in connection with the fulfillment of training measures. This obligation continues even after the termination of the contractual relationship between the Trainer and the client.
Contract Duration
Contracts between the Trainer and the client are generally only concluded for a limited period. The client has the right to withdraw from the contract within the first 14 days from the contract date. Termination is excluded unless there is a permanent medical indication that makes it impossible to continue the contract. Only medical certificates are accepted as proof. Unused units expire after 12 months.
Final Provisions
Changes, additions, and side agreements require written form for their effectiveness, unless otherwise specified in these terms and conditions. The written form requirement also applies to the waiver of this formal requirement. If any of the preceding provisions are invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, an economically reasonable and legally effective substitute provision will be agreed upon unanimously. The place of jurisdiction is determined by legal regulations. Austrian law applies. If a provision of these General Terms and Conditions is invalid, the validity of the remaining provisions is not affected.
